Learner’s Permit (GDL Level 1)

  • Mandatory six (6) months skill-building before road test.
  • Certification of 50 hours behind-the-wheel skill-building, including no less than ten (10) hours of nighttime driving.
  • Supervising adults must be 21 years of age or older; or a parent, guardian, person in loco parentis or spouse.
  • Permit is valid until 18th birthday.
  • Number of passengers must not exceed more than two (2) non-family members in addition to the supervising adult.
  • All occupants must obey West Virginia Seat Belt laws.
  • Must not use a wireless communication device while operating a motor vehicle unless the use of the wireless communication device is for contacting a 9-1-1 system.
  • You may only drive between the hours of 5:00 a.m. and 10:00 p.m.
  • ZERO Tolerance: You may not have any measurable amount of alcohol in your system while operating a motor vehicle.
  • Suspension of driving privileges after receiving two (2) convictions for traffic violations for 90 days and driver must retest and start over.

Intermediate License (GDL Level 2), Age 16–18

  • Must be at least 16 years of age.
  • Have a minimum of 180 consecutive days of conviction-free driving at a Level 1 GDL immediately preceding the date of the application of the Level 2 license.
  • Pass a road skills test.
  • Have a parent or legal guardian certification of a minimum of 50 hours behind the wheel, with a minimum of 10 hours nighttime driving OR complete a driver’s education course approved by the West Virginia Department of Education.
  • Must not use a wireless communication device while operating a motor vehicle unless the use of the wireless communication device is for contacting a 9-1-1 system.
  • If you have an intermediate license and you are under age 18, the following restrictions still apply:
    • License holders may drive without a supervising adult between the hours of 5:00 a.m. and 10:00 p.m. Level 2 GDL intermediate drivers must drive with a licensed supervising adult age 21 or older between the hours of 10:00 p.m. and 5:00 a.m.
      • The only exceptions to this rule are for 1) lawful employment; 2) a school-sanctioned event; 3) a religious event; or, 4) an emergency.
    • Level 2 GDL drivers may not operate a motor vehicle during the first 6 months with any non-family passengers under the age of 20 and may not operate a motor vehicle with more than 1 non-family passenger under the age of 20 during the 2nd six months of being licensed.
  • All occupants must obey West Virginia Seat Belt laws.
  • ZERO Tolerance: You may not have any measurable amount of alcohol in your system while operating a motor vehicle.
  • Mandatory suspension for 2 serious convictions, until 18th birthday.

GDL Level 3, Age 17–18

  • For the driver to be eligible for a Level 3 GDL, they must have completed 12 months of conviction-free driving under a Level 2 GDL.
  • Must be at least 17 years of age.
  • Must have completed all other requirements of a GDL driver.
  • Must not use a wireless communication device while operating a motor vehicle unless the use of the wireless communication device is for contacting a 9-1-1 system.
  • ZERO Tolerance: You may not have any measurable amount of alcohol in your system while operating a motor vehicle.
  • All occupants must obey West Virginia Seat Belt laws.
